Delhi HC का बड़ा एक्शन: BLA वेरिफिकेशन नियम पर Election Commission से मांगा जवाब

Delhi High Court ने 7 August 2026 को Election Commission (EC) से एक petition पर जवाब मांगा है। यह petition Delhi Pradesh Congress Committee (DPCC) के president Devender Yadav और उनके booth management committee के chairman द्वारा दायर की गई है। यह petition EC के उस mandate को challenge करती है जिसमें political parties के Booth Level Agents (BLAs) के लिए personal undertaking देना compulsory किया गया है। इस undertaking में यह certify करना होता है कि उन्होंने Special Intensive Revision (SIR) of electoral rolls के लिए enumeration forms की सभी details को personally verify कर लिया है। Court ने इस मामले की next hearing 12 August के लिए schedule की है।
Petitioners का कानूनी तर्क
Petitioners का कहना है कि ना तो Representation of the People Act और ना ही Registration of Electors Rules में ऐसा कोई provision है जो EC को BLAs से ऐसा personal undertaking मांगने की power देता हो। उनका तर्क है कि यह requirement Representation of the People Act, 1950 के Section 23 के तहत तय statutory verification scheme के against है। यह section यह mandate देता है कि electoral roll में names का inclusion "Electoral Registration Officer द्वारा prescribed manner में facts के proper verification के बाद" किया जाना चाहिए।
Court का पक्ष और वकीलों की दलीलें
Petitioners की तरफ से पेश हुए Senior advocate Sakal Bhushan, साथ में advocates Sunil Kumar और Prateek Sinha ने यह भी assert किया कि rules के तहत verification की prescribed manner statutory officers द्वारा की जानी चाहिए, किसी private individual या party representative द्वारा नहीं। Delhi High Court के Justice Amit Bansal ने Election Commission से इस plea पर अपना stand submit करने को कहा है, क्योंकि court ने BLAs पर personal verification थोपने को statutory function का private actors को unlawful delegation माना है।
